Auction rules

  1. The auction consists in the bidding of works of art or other collector’s items consigned for sale by their Owners, hereinafter referred to as the ‘OWNERS’, or ones which are the property of 4Beauty Art Gallery, hereinafter referred to as ‘4BEAUTY,’ the auction’s organizer.
  2. The auction is conducted solely via the Internet based on an auctioning system controlled by 4beauty. Telephone applications and prior applications submitted by e-mail are acceptable, with a price ceiling stated. On behalf of the Customers, hereinafter referred to as ‘CUSTOMERS’, in that case individuals assigned by 4BEAUTY bid items. Contact: galeria@4beauty.com, +48 609 655 633.
  3. 4BEAUTY undertakes to sell, on behalf of the OWNER, objects which are the actual property of the OWNER, and which are not subject to court or treasury proceedings, free of repossessions or collateral, as well as not burdened by any third party rights.
  4. The OWNER receives the amount auctioned for the item sold, less commissions to the Auction House as well as other costs related to the preparation of items for bidding determined in the course of concluding the auction consignment agreement.
  5. Each item auctioned is accompanied by a photo, description, and the starting price. Descriptions of items and starting prices may be changed prior to commencing the bidding. 4BEAUTY reserves the right to separate or combine items as deemed appropriate, or to withdraw them from the auction without stating the reason.
  6. On-line auctions are not accompanied by a printed catalogue. All items are featured on the Internet at www.4beauty.com.
  7. The auction may be entered by individuals who have registered at www.4beauty.com. 4BEAUTY does not require that auction’s CUSTOMERS pay in a deposit. Individuals who have not registered are authorized to monitor auction’s progress only. To ensure appropriate identification of bidders, individuals who register must state their valid contact details and to grant consent for the data to be reviewed.
  8. The price auctioned is increased by an administrative fee at 15% of the so-called PREMIUM.
  9. 4BEAUTY collects data about CUSTOMERS exclusively in order to make contact in relation to the auction underway as well as for statistical purposes. 4BEAUTY guarantees that personal data will not be disclosed to anyone, nor used for any other purposes. 4BEAUTY authorizes every CUSTOMER to access, modify, and delete their personal details.
  10. Submission of an auction offer via the Internet is binding to the same extent as it happens with a traditional auction. In case a bidder refuses to complete a transaction or avoids contact, 4BEAUTY is entitled to further its rights before a relevant court with a jurisdiction over the company’s registered office address.
  11. 4BEAUTY is not accountable for problems related to the participation in an on-line auction, caused by factors which are beyond 4BEAUTY’s control, in particular: Internet or telephone line failures – both domestic and international connections, or other failures of hardware which does not belong to 4BEAUTY and for which 4BEAUTY is not accountable.
  12. The online auction is conducted automatically. Auction’s progress, i.e. rate does not increase more than 100%. An individual who offers the highest price within the time set for the auction becomes the buyer. The time of declaring the rate as well as the rate’s value are determining factors. When the auction is completed, a relevant message on the computer screen appears. Information about the host of the auction for a specific item appears in the auction window for a given work of art. When the auction is completed at the rate above the starting price, it is equivalent to concluding a purchase agreement.
  13. CUSTOMER - BUYER undertakes to purchase the item within 7 days upon the close of the auction. If the payment is not recorded within dates stipulated, 4BEUATY is entitled to cancel the contract and burden the CUSTOMER – BUYER with any resultant costs.
  14. Rights of ownership to the item purchased are transferred onto the CUSTOMER – BUYER upon settling an entire payment, i.e. price auctioned plus PREMIUM.
  15. 4BEAUTY provides a guarantee confirming the author as well as other features which describe the work of art, issued in the form of a certificate. In case the description does not comply with the actual state of affairs, the CUSTOMER – BUYER may return the item within 14 days of the auction completion date, whereas 4BEAUTY must reimburse the entire amount paid. Calling the description of the item into question must be accompanied by reliable expertise documentation.
  16. 4BEAUTY is not accountable for physical or legal defects of items purchased. Any possible complaints will be processed in line with the Polish law.
  17. Dispatch of the work of art to the CUSTOMER – BUYER is conducted as agreed over the telephone: via courier (an insured parcel) or upon personal receipt in Warsaw or Gdańsk. The cost of the parcel is borne by the CUSTOMER – BUYER.
  18. 4BEAUTY informs that in line with the stipulations of the Law dated 23 July 2003 on the protection and custody over monuments / relics (Journal of Laws issue 162, item 1568), export of specific items outside Poland requires the consent of relevant authorities.
  19. 4BEAUTY informs that in line with the Law dated 21 November 1996 concerning museums (Journal of Laws, dated 1997 Issue 5, item 24, with further amendments) registered museums have pre-emption rights to items directly on auction for an auctioned amount.
  20. 4BEAUTY reminds that in line with applicable regulations, it is obliged to collect personal details of customers who conduct transactions in amounts exceeding EUR 15,000 (Journal of Laws, dated 2003, issue 153, item 1505 with further amendments.)
